Welcome to Second Hugs! These Terms and Conditions (“Terms”) govern your use of the Second Hugs platform as a Vendor. By registering as a Vendor and using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Vendor services.
2.1 Eligibility: To register as a Vendor, you must be at least 18 years old and legally capable of entering into binding contracts.
2.2 Account Creation: Vendors must create an account on Second Hugs. The account will only go live after registration.
2.3 Account Information: You agree to provide accurate, complete, and up-to-date information for your account. You are responsible for maintaining the confidentiality of your account information and password.
2.4 Account Suspension: We reserve the right to suspend or terminate your account if you violate any of these Terms or engage in fraudulent or illegal activities.
2.5 Bank Details: Vendors are required to provide valid bank account details at the time of onboarding to ensure timely and seamless payouts.
3.1 Product Listings: Vendors can list pre-loved kids’ products for sale on Second Hugs. All product listings must be accurate, complete, and comply with our guidelines.
3.2 Approval Process: All product listings will be reviewed and approved by the Admin before they go live on the platform.
3.3 Pricing: Vendors have the flexibility to set their prices. However, prices must be fair and competitive.
Note: The platform fee is charged directly to the buyer and is not included in or deducted from your listed product price or payout.
3.4 Product Quality: Vendors are responsible for ensuring that the products listed are of good quality, clean, and safe for use.
3.5 Prohibited Items: Certain items, such as recalled products, hazardous materials, and counterfeit goods, are prohibited from being sold on Second Hugs.
4.1 Order Notification: When a buyer places an order, the Vendor will receive a notification with order details, including the item description, buyer details, and expected dispatch time.
4.2 Order Fulfillment: Vendors are expected to prepare and dispatch orders within 24 hours of receiving the order notification. Delays must be communicated to the buyer promptly.
4.3 Packaging: Vendors must ensure that products are securely packaged to prevent damage during shipping. Include the invoice inside the box and paste the packing slip on the outside.
4.4 National Shipping: Second Hugs uses Delhivery’s Surface option for shipping. Vendors must hand over the prepared package to the delivery agent.
4.5 Local Pickup: In case of Local Pick up the product must be kept ready by packing it safely for the transit, and transfer it to the buyer by; meeting at a mutual location, or physically handing over the good(s) to the buyer or through any other logistics services as communicated by the admin.
5.1 Payment Processing: Payments for sold items will be processed and credited to the Vendor’s account after the order is delivered and confirmed by the buyer. The payment will be initiated on the 15th and/or 30th of the month.
5.2 Platform Fee:
Second Hugs does not charge any commission to individual vendors (Not registered under GSTIN). Instead, a platform fee is collected from the buyer at checkout. This platform fee is slab-wise and fixed, calculated based on the total cart value of the buyer’s order. It is added on top of the seller’s listed selling price and does not affect the vendor’s payout. In case of registered vendor (registered under GSTIN) Second Hugs charges a commission of 20% commission on each product sales instead of Platform fees.
5.3 GSTIN: You have the ability to provide us your Goods and Services Tax Identification Number (GSTIN) on the platform. Your GSTIN details are mandatory for passing on the credit of GST charged. In case you fail to provide us with your GSTIN details, we will assume that you are not registered with the GST authorities, without independently verifying your registration status. Unless otherwise mentioned on the Website, prices indicated are inclusive of applicable taxes[TB1] .
6.1 No Returns: Second Hugs does not accept returns. All sales are final.
6.2 Refunds: Refunds may be issued in case of issues with the received order after proper inspection. Vendors must cooperate with the resolution process.
7.1 Compliance: Vendors must comply with all applicable laws, regulations, and guidelines.
7.2 Accuracy: Ensure that all information provided in listings and communications is accurate and truthful.
7.3 Conduct: Vendors must conduct themselves professionally and respectfully in all interactions on the platform.
8.1 Content Ownership: Vendors retain ownership of the content they create. However, by listing products on Second Hugs, Vendors grant us a non-exclusive, royalty-free license to use, display, and distribute this content.
9.1 Violations: Any violation of these Terms, including but not limited to, listing prohibited items, providing false information, or failing to fulfill orders in a timely manner, may result in penalties.
9.2 Types of Penalties:
9.3 Dispute Resolution: Vendors may appeal penalties by contacting our support team. All appeals will be reviewed, and decisions will be made on a case-to-case basis.
10.1 Modifications: We reserve the right to modify or replace these Terms at any time. The Vendors are responsible to be updated with the material changes if any.
